Section 3.2: Boat Slips

3.2.1: Availability and Fees

  1. Boat slips may be available for use by Residents for an annual fee, subject to availability and compliance with the Association's policies and guidelines.

Section 3.3: Assumption of Risk

3.3.1: Use at Own Risk

  1. Residents and their Guests may utilize the amenities at their own risk.

  2. The Association assumes no liability for any damages, losses, or injuries sustained while using these facilities.

Section 3.4: Temporary Docking

3.4.1: Temporary Dockage

  1. Temporary dockage is not permitted.

  2. Owners may beach their vessel at their own risk for a period not to exceed seventy-two (72) hours.

Section 3.5: Parking Restrictions

3.5.1: Parking Prohibition

  1. Individuals using the docks or lakeshore amenities are strictly prohibited from parking vehicles in the areas adjacent to Buildings 7 and 8.

Section 3.6No Swimming Near Boat Slips

3.6.1: Swimming within 100 Feet of Boat Slips

  1. For the safety of all residents, guests, and visitors, swimming is strictly prohibited within 100 feet of the boat slips. This rule is in place due to the potential hazards posed by electrical currents in the water from nearby power sources, as well as the increased risk of injury from boats and related equipment.

    1. Violating this rule endangers lives and may result in fines or other penalties as determined by the HOA or property management. Please ensure all swimmers are aware of and comply with this safety regulation.

Section 3.7: Enforcement and Penalties

3.7.1: Violations of Parking Restrictions

  1. Any violation of the parking restrictions outlined in Section 3.5 will result in the following penalties:

    1. A fine of $100 for the first occurrence.

    2. Fines will double for each subsequent occurrence.

    3. Fines will be charged to the Unit Owner’s account and subject to the same collection procedures as delinquent regime assessments.

    4. Unauthorized Use of Amenities
      Any unauthorized use of amenities, including but not limited to extended use of beaching a watercraft beyond the allowed seventy-two (72) hours, will result in:

    5. A fine of $150 for the first occurrence.

    6. A fine of $300 for each subsequent occurrence.

    7. Possible suspension of amenity privileges for the violator.

3.7.2: Damages to Amenities

  1. If any damage occurs to the amenities (including any other Association facility) due to misuse or violation of these rules, the responsible Owner will be held financially liable for the costs of repair and restoration, including any additional fines.

Article 6: Boat Docks, Slips, and Boat Parking

 Section 6.1: Boat Docks, Slips, and Boat Parking

 6.1.1: Application and Term

 6.1.2: Application for Boat Slip

1.    Owners may apply for a boat slip for a term of one (1) year, with the term running from July 1st through June 30th.

2.    Applications for boat slips must be submitted annually, with the application process opening in June of each year.

6.2 Allocation and Priority

 6.2.1: First Right of Refusal

 1.    Current boat slip holders shall be granted the first right of refusal to renew their boat slip for the following year.

6.2.2: Waiting List

 1.    A waiting list shall be maintained for Owners interested in securing a boat slip. Available spots will be allocated to Owners on the waiting list in the order their application is received.

6.3: Fees

 6.3.1: Annual Fees

 1.    Fees for boat slips and parking spaces must be paid in advance and are as follows:

2.    Covered Boat Slip: Two thousand four hundred dollars ($2,400) per year.

3.    Uncovered Boat Slip: One thousand eight hundred dollars ($1,800) per year.

6.3.2: Non-Refundable Fees

1.    Fees are non-refundable, regardless of whether the boat is removed prior to the end of the term.

6.3.3: Restrictions

 1.    Subletting and Transfer Prohibited

2.    Subletting or transferring boat slips is strictly prohibited.

3.    Unauthorized Watercraft

4.    Unauthorized watercraft shall be towed from the premises at the Owner’s expense.

6.5: Documentation Requirements

 6.5.1: Submission of Required Documents

 1.    All necessary documentation must be submitted to the Association office thirty (30) days prior to occupying a boat slip. Required documentation includes:

2.    A copy of the Owner's driver’s license.

3.    A copy of the boat registration.

4.    Proof of insurance for the boat.

6.5.2: Boat Registration

 1.    All boats must be properly registered with the state and the Association office.

6.6: Enforcements and Penalties

 6..6.1: Non-Compliance and Revocation of Rights

 1.    Failure to comply with these rules and regulations may result in the revocation of the right to use the boat slip.

2.    Towing of Unauthorized Watercraft

a.    Unauthorized watercraft parked in the boat slip may be towed or removed at the Owner’s expense.

6.6.2: Enforcement of Fees and Violations

 1.    Late Payment and Revocation

2.    In the event of non-payment or late payment of boat slip fees, the Association reserves the right to revoke the Owner's use of the boat slip until payment is received in full.
Non-payment for an extended period may result in additional penalties, including towing of watercraft at the Owner's expense.

Article 7: Boat Trailer Parking

 Section 7.1: Application and Term

 7.1.2: Application for Boat Trailer Parking Space

1.    Owners may apply for a boat trailer parking space for a term of one (1) year, with the term running from July 1st through June 30th.

2.    Applications for boat trailer parking spaces must be submitted annually, with the application process opening in June of each year.

3.    Boat trailer parking spaces are limited to trailers that fully fit within the designated space. Trailers exceeding the length of the space are not permitted. Each space is designed to accommodate a trailer up to twenty (20) feet in length, and no larger.

Section 7.2: Fees

7.2.1: Annual Fee

 1.    Owners who maintain an active boat slip lease may lease one boat trailer parking space for a trailer twenty (20) feet in length or less for an additional fee of three hundred dollars ($300) per year, payable in advance.

2.    Owners who wish to lease a boat trailer parking space only, for a trailer twenty (20) feet in length or less, shall be charged five hundred dollars ($500) per year, payable in advance.

3.    Boat trailer parking spaces are available on a first-come, first-served basis.

7.2.2: Non-Refundable Fees

 1.    Fees are non-refundable, regardless of whether the boat trailer is removed prior to the end of the term.

Section 7.3: Documentation Requirements

 7.3.1: Submission of Required Documents

1.    Owners must complete and submit all necessary documentation prior to parking a boat trailer in an assigned space. Required documents include:

a.    A completed application for boat trailer parking.

b.    Proof of ownership or registration for the boat trailer.

c.    Any other documentation requested by the Association.

2.    Display of Association Decal

a.    An Association decal must be displayed on the boat trailer at all times.

Section 7.4: Restrictions and Enforcement

 7.4.1: Unauthorized Trailer or Vehicle Parking

 1.    Unauthorized trailers or vehicles parked in designated boat trailer spaces may be towed at the Owner’s expense.

7.4.2: Violation of Rules

1.    Any violation of these rules, including failure to display a valid Association decal or parking without proper documentation, may result in the revocation of parking privileges.

 7.4.3: Enforcement of Fees and Violations

 1.    Owners who violate these rules shall be subject to fines and penalties as determined by the Board of Directors (BOD), which may include the towing of unauthorized vehicles at the Owner's expense.

2.    Continued violations may result in additional enforcement actions, including suspension or permanent revocation of parking privileges.

Section 7.5: Enforcement and Penalties

 7.5.1: Violation Fines

 1.    A fine of fifty dollars ($50) per occurrence will be assessed for any unauthorized vehicle or trailer parked in designated boat trailer spaces.
The fine will double for each subsequent violation of the same rule or regulation.

7.5.2: Revocation of Parking Privileges

 1.    Failure to comply with the boat trailer parking rules and regulations may result in the revocation of parking privileges and/or additional fines as deemed appropriate by the BOD.

7.5.3: Towing of Unauthorized Vehicles

1.    Any unauthorized vehicles or trailers parked in boat trailer spaces will be towed at the Owner's expense, and the Owner will be liable for all towing and storage fees.
